These website and customer terms work together with each estimate, service authorization, work order, invoice, and service-specific terms page. If an accepted written estimate or work order conflicts with these general terms, the order-specific written terms control for that service.
1. Company and acceptance
These Terms & Conditions govern use of pestarrest.org, the Pest Arrest customer portal, online scheduling or payment features, and general dealings with Pest Arrest Exterminator LLC. By using those services or accepting an estimate or service, you agree to the terms that apply to that activity.
2. Estimates, scope, and authorization
Website descriptions and prices are general offers or starting points. The accepted estimate, service authorization, or work order identifies the actual property, target pest or service objective, included areas, visit frequency, price, preparation, exclusions, and warranty. Pest Arrest may decline or stop work because of unsafe access, weather, incomplete preparation, licensing limits, label requirements, undisclosed conditions, or work outside the authorized scope.
3. Prices, taxes, and payment
Customers are responsible for authorized charges, applicable taxes, and disclosed fees. Payment is due as stated on the estimate, invoice, or work order. Recurring charges require the customer's affirmative authorization and continue under the Recurring Service Terms until canceled. A price displayed online may change after inspection if property size, infestation, access, travel, materials, or requested scope differs from the published assumptions.
4. Customer responsibilities
The customer must provide safe and lawful access; accurate information about occupants, pets, sensitivities, prior treatments, and conditions relevant to service; complete required preparation; secure pets; protect food and personal property as instructed; maintain sanitation, moisture control, landscaping, repairs, and exclusion measures reasonably requested; and follow all post-service precautions.
5. Pesticide and safety controls
Product labels and applicable law control every pesticide application. Pest Arrest determines products, methods, timing, and treated areas based on inspection, label directions, licensing, weather, and site conditions. Required Texas consumer information, treatment notices, labels, and safety information are incorporated where applicable and are not replaced by these terms.
6. Results, warranties, and re-service
Pest activity is affected by weather, neighboring properties, sanitation, moisture, harborage, structural openings, customer conduct, and other conditions outside Pest Arrest's control. Unless an accepted estimate or written warranty states otherwise, no service guarantees total elimination, permanent prevention, or a specific time to result. Any warranty or re-service obligation is limited to the written service scope and stated period.
7. Cancellations and refunds
The Cancellation Policy and Refund Policy are incorporated into these terms. Recurring residential plans have no fixed contract term and may be canceled anytime, subject to charges already incurred. Appointment cancellation/no-access fees apply only when separately disclosed.
8. Website use and intellectual property
Website content is provided for general information and may not be copied, scraped, republished, misrepresented, used to interfere with the site, or used for unlawful purposes. Pest Arrest's names, logos, photographs, copy, forms, and original materials remain its property or are used with permission.
9. Disclaimers and limitation
To the fullest extent permitted by law, website and portal functions are provided on an "as available" basis. Pest Arrest is not liable for indirect, incidental, special, exemplary, or consequential damages arising from website use or a service, and direct liability will not exceed the amount paid for the service giving rise to the claim. This limitation does not apply where prohibited by law or to liability that cannot legally be limited.
10. Disputes and governing law
Please contact Pest Arrest promptly so concerns can be investigated and corrected. Texas law governs these terms without waiving any nonwaivable consumer right. Any court proceeding must be brought in a court with jurisdiction over Comal County, Texas, unless applicable law requires another venue. Nothing in these terms waives rights or remedies that cannot lawfully be waived.
11. Electronic communications and changes
You consent to receive service authorizations, notices, invoices, and records electronically when you provide an email address, mobile number, portal authorization, or electronic acceptance, subject to your communication choices. We may update these general terms prospectively by posting a revised version. A material change to an existing recurring plan will be communicated under the Recurring Service Terms.
